Possession for sale is a criminal offense that occurs when a person has one or more drugs (illegal narcotics) in his/her possession and he/she is carrying the drugs with the intention to sell to the drugs to a third party or parties. 

When a person is suspected of committing possession for sale, law enforcement must be able to prove that the person actually intended to sell the drugs before they can make a legitimate arrest.  Often times, law enforcement is able to conclude that a person intended to sell the narcotics in his/her possession if the person is carrying a large amount of the narcotic or if the person is carrying a lot of cash.  Law enforcement may also conclude that a person is committing possession for sale if they find the person talking or “dealing” with a third party and witness an exchange of money or drugs. 

Possession for Sale – Criminal Charges

After a person is arrested for possession for sale, he/she may be charged with either a misdemeanor or a felony drug offense.  The severity and classification of the drug offense will depend upon:

  • the type of drug possessed
  • the amount of drug possessed
  • if the person solicited to minors
  • the person’s criminal background
  • if the person has had prior drug crime convictions

For example, if a person possessed a large amount of cocaine and he/she was found selling the narcotic, he/she may be charged with a felony, whereas a person who possessed and intended to sell a small amount of marijuana may only be charged with a misdemeanor.
